The engagement

A small environmental engineering company based in Northern Virginia was seeking SBA 8(a) certification to expand its business with the federal government. The firm had a long-standing relationship with a prime contractor and was ready to take the next step in its growth.

RMC prepared and submitted the firm’s SBA 8(a) application, meeting the requirements of the Small Business Administration. Following its review, the SBA denied the firm’s certification because of affiliation concerns related to its relationship with the prime contractor, who was also the owner’s former employer.

RMC prepared an extensive appeal on behalf of the client, explaining why the firm was not affiliated with the prime contractor under the rules outlined in 13 CFR 121.103. After several clarification exchanges with the SBA, the firm was approved as an SBA 8(a) certified company.

These activities included:

  1. 1.Preparing and submitting the SBA 8(a) application
  2. 2.Addressing affiliation issues raised during the SBA review
  3. 3.Preparing an appeal addressing the affiliation rules
  4. 4.Supporting clarification exchanges during the appeal process

The results achieved were as followed:

  • The client successfully appealed the initial SBA decision
  • The affiliation concerns were resolved
  • The firm was approved as an SBA 8(a) certified company
